Claims from an accident ...who takes care of this?

My children are covered by BCBS of IL with my ex-husband being the subscriber.  My question is regarding claims caused by an accident my daughter was in...who takes care of the payment for those claims?  The insured or the insurer? The other party is at fault for the accident and the bills are accumulating.  I am settling with the Auto Insurance soon and am unclear how I should go about this. Do I trust that they will pay all the bills as they have agreed, or do I pay them with the settlement $$ myself?  Any insight would be appreciated.  Thanks

  • Hello, We would need to look at your daughter's plan to ensure how that specific plan handles these situations. Many of our plans however follow a pay and pursue policy which means we would process any claims we receive based on the plan's benefits for the services rendered and then, if we have notice that the service may be related to an accident, we would review those claims to see if another party, such as a car insurance company, should be responsible for those expenses. If we determine another party is liable for those expenses we would then contact them to get this straightened out. Again we would need to look at her plan to be sure how her claims would be handled in this situation. We would need her plan ID and your contact information to look into this. Also, we would need to have something on file, such as permission from the policy holder or a legal document, letting us release this information to you if you are not also covered under this plan. ~ Kayla
